Fire Inspections in apartments?

Posted by admin on May 19th, 2010 and filed under fire inspection | 2 Comments »

I live in Indiana, and I just found out that next week my apartment is having the fire department come and inspect the whole apartment building (including where we live).

This seems like a violation of privacy. Does anyone know an Indiana Law I can cite to tell them I do not want them in my apartment?

Nope. Tenants are required to provide landlords with reasonable access (with appropriate advance notice) to their units. Code compliance is absolutely a valid reason for gaining access to your unit and is for your own protection. Sorry.

"This seems like a violation of privacy." NO it is not. Tenants have very little right to privacy.

"Does anyone know an Indiana Law I can cite to tell them I do not want them in my apartment?" NO! because there is none. They have the right to go in & you get no say in the matter.

No tenant has the right to keep the landlord out of their unit so long as they have been given proper notice. The purpose of the fire department coming is to make sure there are no fire hazards & to make sure all the fire alarms & sprinklers (if there are any) are working properly. How would you feel if they did not do this inspection & you lost everything in a fire? I’ll bet you would be on here asking how you could sue them.
